Supreme Court sets aside Delhi HC verdict decriminalising gay sex

The Supreme Court of India on Wednesday held that homosexuality or unnatural sex between two consenting adults under Section 377 of the Indian Penal Code is illegal. It will continue to be an offence.

This verdict seems a major set back to the gay marriage supporters. A Bench of Justices G.S. Singhvi and S.J. Mukhopadaya set aside the Delhi High Court’s verdict decriminalising homosexuality.

 

The court also suggested that if they want to do any changes in the current status, they should bring changes in it through legislation in the parliament.


The Bench told, “While reading down Section 377, the High Court overlooked that a miniscule fraction of the country’s population constitutes lesbians, gays, bisexuals or transgenders, and in the more than 150 years past, less than 200 persons have been prosecuted for committing offence under Section 377. On the basis of the above facts, they declined any changes in the current status.


Experts believe that the thinking of the mass on this issue is confusing and divided one. It will be hard to come out with a clear consensus on the issue. Even the developed countries are divided on this topic, for instances, UK has given a legal status to this recently whereas Australia has declined it from giving it a legal yes.


It will be interesting to see how the different political parties take their opinion on this in the future. Although Congress is favouring the gay marriage but it seems that gay marriage supporters have to walk a long path for getting it done.
